eligibility

Though we aim for Behold Beauty to be appropriate for everyone, this app is generally intended for those 16 and older. If you are under 18, you represent that a parent or legal guardian is aware of your use of the app and accepts these terms on your behalf.

your account

You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information during signup. One person may not maintain multiple accounts to evade enforcement of these terms.

your content

You retain ownership of the videos, images, comments, and other content you post ("user content"). By posting user content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and display that content as needed to operate the app and as described in this agreement. This license ends when you delete the content or your account, except for copies already created by sub-processors and any cached copies in transit on the CDN, which are removed in the ordinary course of operations.

You represent that you own or have all necessary rights to post the content you upload, that it does not infringe any third party's intellectual-property or privacy rights, and that it complies with these terms.

acceptable use

You agree not to:

— Post content that is unlawful, hateful, sexually explicit, violent, harassing, or that exploits minors.

— Post content that is mature, inappropriate, or that would be considered beyond a PG-level standard, including the use of profanity.

— Post content you do not own or have proper license or permission to share.

— Impersonate another person or misrepresent your affiliation with anyone.

— Harvest, scrape, or otherwise programmatically collect data from the app.

— Attempt to inflate engagement metrics, evade rate limits, or interfere with the app's normal operation.

— Use the app to send spam, phishing, or malicious links.

data usage

The app streams and uploads video content which may consume significant amounts of mobile data. You are solely responsible for all data charges, overage fees, and costs imposed by your mobile carrier or internet service provider in connection with your use of the app. We recommend connecting to Wi-Fi when uploading or streaming videos.

reporting and moderation

We may remove any content and suspend or terminate any account at our discretion, with or without notice, for any violation of these terms or for any reason we believe is necessary to protect users or the integrity of the app. We are not obligated to monitor all user content but may do so.

ending your account

You can delete your account at any time from profile settings. Once deletion is confirmed, your account, content, and derived data are removed as described in our privacy policy. Deletion is permanent and cannot be reversed.

We may end your access to the app for any of the reasons listed above. If we do, we will make reasonable efforts to remove your content from the app in a timely manner; however, we reserve a reasonable period of time to complete removal, including from cached copies, CDN edge nodes, backups, and any other systems where content may have been distributed. You agree that we may handle the removal of content and related matters as we reasonably see fit, and that we act in good faith in doing so.

disclaimers

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any content posted by other users is accurate or appropriate.

limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the app.

hold harmless and indemnification

You agree to indemnify, defend, and hold harmless Behold Beauty and its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the app; (b) content you post or upload; (c) your violation of these terms; or (d) your violation of any third party's rights, including intellectual-property or privacy rights. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

apple

If you downloaded the app from Apple's App Store, Apple is not a party to these terms and has no obligation to provide support or handle claims related to the app. Apple has no responsibility for the app or its content.

warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU UNDERSTAND AND EXPRESSLY AGREE THAT THE BEHOLD BEAUTY APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

changes to these terms

We may update these terms. You can check periodically for changes and they are effective as you continue use of the app.
